By downloading, accessing, or using the Project Direct Quote (PDQ) mobile application ("App"), you ("User," "you," or "your") agree to be bound by this Privacy Policy ("Policy"). If you do not agree to this Policy, do not use the App.

The App is owned and operated by Project Direct Quote LLC ("Company," "we," "us," or "our"), located at www.projectdirectquote.com

Description of Service

The Project Direct Quote (PDQ) App is a digital platform that serves solely as a tool to generate immediate responses to construction and contracting project requests submitted by users. The App connects users with construction professionals and contractors but does not provide construction services directly.

Limitation of Liability and Disclaimers

No Liability for Property or Personal Harm

THE COMPANY, ITS OWNERS, OPERATORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY HARM, DAMAGE, INJURY, OR LOSS CAUSED TO PROPERTY OR PERSONS ARISING FROM OR RELATED TO THE USE OF THIS APP.

Users assume all risks associated with using the App and engaging with professionals through the platform.

Tool Functionality Only

The App functions exclusively as a digital tool for generating immediate responses to project requests. The Company does not guarantee the accuracy, completeness, reliability, or quality of any responses, quotes, or professional services obtained through the App.

Professional Services and Liability

Professional Responsibility

Any construction professional, contractor, or service provider ("Professional") who causes damage to persons or property shall be solely and exclusively responsible for any repair, replacement, or remediation required due to their negligence, incompetence, or inability to perform services properly.

No Company Oversight

The Company does not supervise, control, or monitor the work performed by Professionals accessed through the App. All Professional services are independent contractor relationships between the User and the Professional.

Location Data Disclosure

Project Direct Quote collects and processes Approximate Location and Precise Location data to enable core app functionality. This data is collected to:

• Allow Service Providers to receive job leads in their immediate vicinity.
• Help Customers locate nearby service providers for faster response times.
• Provide accurate routing and distance estimates between parties.

This location data is collected while the app is in use (foreground) and, if the user provides explicit permission, may be collected when the app is closed or not in use (background) to ensure timely job notifications.

Location Services and Privacy Risks

Location Sharing at Own Risk

Users who choose to share their location information through the App do so at their own risk. The Company is not responsible for any consequences, harm, or unauthorized access that may result from location disclosure.

Privacy Considerations

Users acknowledge that sharing location data may present privacy and security risks, including but not limited to unauthorized access to personal information or physical premises.

User Verification and Background Checks

Verified Users Only

Background checks are conducted exclusively for verified users who have completed the Company's verification process. Verification status will be clearly indicated within the App.

Non-Verified Users Warning

Users who have not completed verification ("Non-Verified Users") have not undergone background checks. The Company strongly advises that all interactions with Non-Verified Users should be approached with caution. Users assume full responsibility when engaging with Non-Verified Users.

No Guarantee of Verification Accuracy

While the Company endeavors to conduct thorough background checks for verified users, no verification process is foolproof. The Company does not guarantee the accuracy or completeness of background check results.

Indemnification

Users agree to indemnify, defend, and hold harmless the Company, its owners, operators, employees, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Use of the App
• Engagement with any Professional through the App
• Any construction work or services obtained through the App
• Violation of this Policy
• Any third-party claims related to User's activities on the App

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Modification of Policy

The Company reserves the right to modify this Policy at any time. Users will be notified of material changes, and continued use of the App constitutes acceptance of the modified Policy.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

Severability

If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Fees and Payments

All transactions conducted through the Project Direct Quote (PDQ) app will include an additional fee of 11% to cover taxes, operational expenses, and company profit.
